Terms of Service
These terms are an agreement between you and the operator of TrailyMap
(“we”, “us”) about your use of the TrailyMap mobile application and the
trailymap.lat website (together, the “Service”). By creating an
account or using the Service you accept these terms.
1. What the Service is
TrailyMap is a catalogue of hiking, running and cycling routes with maps, photos, descriptions and search. Route data, tracks, photographs and descriptions are aggregated from publicly available open sources and content created by third parties — ordinary people on the internet. They are provided for general information only. We did not create this content, we do not inspect, maintain or verify it, and we accept no responsibility for it: it reflects what its authors published, not what we know or assert.
2. Outdoor activities — assumption of risk
2.1 The data may be wrong
Routes in the catalogue may be inaccurate, outdated or simply incorrect. A trail may be closed, flooded, rerouted, overgrown, private, or may no longer exist. Surfaces, distances, elevation, difficulty grades, duration estimates and “loop” markings are estimates produced by software over third-party content, not statements of fact verified on the ground. The underlying routes were drawn up by third parties whose skill, equipment and conditions may be nothing like yours. Weather forecasts shown in the app are third-party predictions and may be wrong.
2.2 You decide, you carry the risk
To the maximum extent permitted by law, you use routes and any other information from the Service at your own risk. Outdoor activity involves inherent dangers, including but not limited to: falls, unstable terrain, rockfall, avalanches, water hazards, sudden weather changes, wild animals, getting lost, exhaustion, injury and death. By using the Service you knowingly and voluntarily assume all such risks.
2.3 Your obligations when outdoors
You agree that before and during any activity you will:
- assess your own fitness, experience and equipment against the conditions;
- check current local conditions, closures, and official warnings from park authorities, land managers or emergency services;
- not rely on the app as your only means of navigation — carry an independent map or navigation device where conditions warrant it;
- not rely on your phone or the app for emergencies: mobile coverage may be absent on a route, batteries fail, and the Service has no emergency or rescue function of any kind;
- obey local laws, signage, closures and the instructions of authorities;
- supervise any minors in your care at all times.
2.4 No professional advice
Nothing in the Service is professional advice — not mountaineering advice, not medical advice, not training advice. Difficulty grades and fitness scores are generic labels, not an assessment of your abilities.
3. Your account
- You must provide accurate information and keep your password safe. What happens under your account is your responsibility until you tell us it was compromised.
- One person — one account. Accounts are not transferable.
4. Acceptable use
You agree not to:
- scrape, bulk-download or republish the catalogue or its photographs;
- probe, overload, or interfere with the Service, or bypass its rate limits and technical restrictions;
- use the Service to violate any law, or anyone’s rights;
- upload content (for example a profile photo) that is unlawful, infringing or offensive;
- resell or commercially exploit the Service without our written permission.
We may suspend or terminate accounts that violate these rules.
5. Subscriptions and payments
- Some features require a paid subscription. Prices and billing periods are shown before purchase.
- Payment, renewal and cancellation are processed by Apple App Store or Google Play under their terms. Subscriptions renew automatically until cancelled in your store account settings; deleting the app does not cancel a subscription.
- A free trial, where offered, converts into a paid subscription unless cancelled before the trial ends.
- Refunds are handled by the store under the store’s rules; we cannot issue them directly.
6. Intellectual property
- The Service, its design and software are ours or our licensors’. These terms give you a personal, non-exclusive, non-transferable right to use the app for its intended purpose, and nothing more.
- Map and route data include material © OpenStreetMap contributors, available under the Open Database License. Attribution shown in the app must not be removed.
- Content you upload remains yours. You grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce and display it in connection with the Service. This licence survives the deletion of your account or of individual content, to the extent copies persist in backups or in content already distributed as part of the Service.
7. Availability and changes to the Service
The Service is provided “as is” and “as available”. We may change, suspend or discontinue any part of it, and we do not promise uninterrupted or error-free operation. We may modify or remove catalogue content at any time, including where a source requires it.
8. Disclaimer and limitation of liability
To the maximum extent permitted by applicable law:
- we make no warranties, express or implied, about the Service or the accuracy of any route or other content;
- we are not responsible for content originating from third parties or open sources — including routes, tracks, photographs and descriptions published by other people;
- we are not liable for personal injury, death, or property damage arising from outdoor activities undertaken using information from the Service, such risks being assumed by you under section 2;
- we are not liable for indirect, incidental, special or consequential damages, or loss of data or profits;
- our total aggregate liability for all claims relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim and 50 EUR.
Some jurisdictions do not allow certain exclusions or limits; where that is the case, these provisions apply to the fullest extent the law allows, and nothing in these terms excludes liability that cannot lawfully be excluded — including liability for death or personal injury caused by our own gross negligence or intent.
9. Indemnity
If a third party brings a claim against us arising from your breach of these terms or your unlawful use of the Service, you agree to indemnify us against the resulting losses and reasonable costs.
10. Termination
- You may stop using the Service and delete your account at any time in Settings. Deleted accounts can be restored within 14 days by signing in; after that, the account and its data are permanently removed.
- We may suspend or terminate your access for a material breach of these terms. Where reasonable, we will warn you first.
- Sections that by their nature should survive termination (2, 6, 8 and 9) survive it.
11. Changes to these terms
We may update these terms. For significant changes we will notify you in the app and give you a chance to review before they take effect. Continued use after the effective date constitutes acceptance. The current version is always available at this address.
